Pit <br />SIGNED BY: <br />DATE: <br />JACKSON COUNTY CLERK AND RECORDER <br />COUNTY CLERK <br />List of revised items placed with the Jackson County Clerk: <br />• Response to the Division's Adequacy Review Letter dated October 4, 2011 which <br />includes: <br />1. As required by Rule 1.6.3(3), please submit proof of publication in a newspaper <br />of general circulation in the locality of the proposed mining operation. <br />2. As required by Rule 1.6.2 (e, please submit proof of the notice to all owners of <br />record of surface and mineral rights of the affected land and the owners of record of all <br />land surface within 200 feet of the boundary of the affected land including all easement <br />holders located on the affected land and within 200 feet of the boundary of the affected <br />land. Proof of notice may be return receipts of a Certified Mailing or by proof of <br />personal service. <br />3. The Division received comments from the Army Corps of Engineers. The letter is <br />attached for your review. Please address the comments noted in the letters and make any <br />changes in the application as necessary. <br />Exhibit A — Legal Description (Rule 6.3.1) <br />4. Please revise the legal description to correspond the permitted acres (3.84) <br />indicated on the application form. The description shall be by township, range, and <br />section, to at least the nearest quarter - quarter section. A metes and bounds survey <br />description is also acceptable. <br />Exhibit B — Site Description (Rule 6.3.2) <br />5. The Applicant states two permanent man -made structures are within 200 feet of <br />the affected boundary, however only one structure (the CDOT right of way fence) is <br />identified. Please explain this discrepancy and revise the exhibit accordingly. <br />6. The Applicant states storm water will be contained within the pit area and drain <br />on to the adjacent Corkle Construction permitted mine site where it is dealt with under <br />the provision of its permits. Please verify the CDPHE storm water permit for the Corkle <br />Pit. File No. M -1995 -023 has been revised to incorporate the additional acreage <br />contained in the proposed reclamation only permit site. <br />Exhibit C — Mining Plan (Rule 6.3.3) <br />7. Please update the dimensions of any significant site disturbance required by Rule <br />6.3.3(f)to indicate the revised (3.84) permit acreage. <br />Exhibit D — Reclamation Plan (Rule 6.3.4) <br />8. The Applicant proposed a reclamation bond amount of $2000.00 per acre. The <br />proposed per acre amount is acceptable to the Division; however the total acreage amount <br />must be updated to accommodate the revised permit acreage of 3.84 acres. The Division <br />
