OBSERVATIONS <br />PERMIT #: M- 1983 -089 <br />INSPECTOR'S INITIALS: BMK <br />INSPECTION DATE: November 18, 2011 <br />1) The Division conducted a monitoring inspection of the site on 11/18/11. The site was active at the time <br />of the inspection. Present during the inspection was Mr. John Miner the operator. <br />2) The site is a 112 phased sand and gravel operation located approximately 3 miles south east of Castle <br />Rock. The total permitted acres is 66.50 of which, the operator can only affect 17 acres at any given <br />time. The operator must be aware that the total affected acres include any area being utilized as part <br />of the operation and not limited to mining areas. These areas include but not limited to equipment <br />storage areas and other ancillary disturbances. The operator must submit a better map of the total <br />permitted and affect areas at present and use this map to report the affected acres in the annual <br />report. <br />3) The current active mining pit is located along the North West side of the permit area. Pit slopes <br />appeared stable. There was a small puddle of water that was exposed at the bottom of the pit. The <br />source of this water did not appear to be shallow ground water; however it could be from the adjacent <br />perennial stream, because the depth of the mining elevation is below the invert of the channel or from <br />the larger watershed up gradient of the permit area. Since the true hydraulic conductivity for the pit is <br />not clearly defined, it is difficult to determine the actual source of the exposed water. The operator <br />agreed to backfill all exposed ground water once mining is completed. He also stated that there is a <br />waters substitute supply plan in place. However the substitute water supply plan from the State <br />engineer is not part of the permit application .If there is an approved water substitute supply plan; the <br />operator is encouraged to submit the plan from the State Engineers Office for our records. <br />4) The Division is currently holding a financial warranty in the amount of $98,189.00 to cover the cost of <br />reclamation. Once the operator provides an accurate map of the permit and affected areas, the <br />warranty for the site will be re- calculated. The operator is also encouraged to remove all the old <br />mining equipments that area for sale scattered throughout the permit area and place them outside of <br />the permit area or in a designated location of the permit where the Division can calculate the required <br />warranty for the affected area by these old mining equipments. This area can be designated as a bone <br />yard area requiring only seeding and could be designated as minor disturbance area. <br />Page 2 of 4 <br />
