PART I <br />Page No. 28 <br />Permit No.: CO-0000213 <br />i) Stormwater discharges from mining operations or mine-waste remediation prqjects shall not cause or threaten to <br />cause pollution, containination or degradation of State waters. <br />ii) Bulk storage structures for petroleum products and other chemicals shall have secondary containment or other <br />equivalent protection adequate protection so as to contain all spills and prevent any spilled material from entering State <br />waters, <br />iii) No chemicals are to be added to the discharge unless permission for the use of a specific chemical is granted by the <br />Division. In granting the use of such chemicals, special conditions and monitoring may be addressed by separate letter. <br />iv) All dischargers must comply with the lawful requirement,% of counties, drainage districts and other state or local <br />agencies regarding any discharges of ston-nwater to storm drain systems or other water courses under their jurisdiction. <br />c. SWMP Requirements <br />i) SWMP Submittal/Review/Changes: <br />C, <br />a) Division Review-, The Division reserves the Tight to request and review the plans, and to require additional <br />measures to prevent and control pollution, as needed. Upon review of the SWMP, the Division may notify <br />thu permittee at any time that the plan does not meet one or more of the minimum requirements of this <br />permit. After such notification, the permittee shall make changes to the plan and shall submit to the <br />Division an update to the plan including the requested charges. Unless otherwise provided by the Division, <br />the permittee shall have 30 days after such notification to both make the necessary changes to the plan and <br />to implement them. <br />If the Division determines that the permittee's discharges may cause, have the reasonable potential to cause, <br />or contribute to an excursion above any applicable water quality standard, the Division may require the <br />permittee, within a adequately address the identified water quality concerns. <br />b) Pu-nnittee Review/Cliange: The permittee shall amend the plan whenever there is a change in design, <br />construction, operation, or maintenance which has a significant effect on the potential for the discharge of <br />pollutant-, to the waters of the State, or if the 8W.M1' proves to be ineffective in achieving the general <br />objectives of controlling pollutants in stormwater discharges associated with mining activity. If existing, <br />BMPs need to be modified or if additional BMPs are necessary, the plan changes and implementation must <br />be completed before the next anticipated storm, or not more than 60 days after: the change in design, <br />construction, operation, or maintenance, or, the SWMP has been determined to be ineffective, unless this <br />time frame is extended by the Division. Amendments to the plan shall be summarized in the Annual or <br />Compliance Report. The Division reserves the rip-lit to require additional measures to prevent and control <br />pollution, as needed. <br />ii) SWMP Retention: The plan shall be retained on site. <br />Prohibition of Non- stormwater Discharges <br />i) Except as provided in paragraph b, beloNk, all discharges authorized by the stormwater portion of this permit shall be <br />composed entirely of stormwater. Discharges of water other than stormwater must be addressed in a separate CDPS <br />permit issued for that discharge, <br />ii) Discharges from the following sources that are cornbined with stormwater discharges associated with mining activity <br />may be authorized the stormwater portion of this permit, provided that the non- stormwater component of the <br />discharge is identified in the SWMP (see Part I.D2.c of the permit): fire fighting activities, uncontaminated <br />compressor condensate, irrigation drainage, lawn watering, air conditioner condensate, uncontaminated seeps and <br />springs, and foundation or footing drains where flows are not contaminated. <br />e, Facility Inspections <br />
