The Division of Reclamation, Mining and Safety, in accordance with Title 34, Article 33, of the Colorado
Revised Statutes, hereby issues notice that on November 9, 2011, a minor revision application (MR -102)
to the New Elk Mine, Permit No. C- 1981 -012, operated by New Elk Coal Company, LLC, 122 West First
Street, Trinidad, CO 81082 was considered complete for the purposes of filing. New Elk Coal Company
(NECC) proposes to relocate Slurry Wells #2 and #3. Relocation of these previously approved holes is
necessary due to drilling conditions encountered during construction of Slurry Well #1. The new location
will be further to the West closer to the West Portals. All reviews and comment periods as provided in
the Act and Regulations promulgated thereunder initiate from this date of filing.
