(BMRI) currently operates under an augmentation plan decreed in <br />Case No. 99CW057 and has pending an augmentation plan that includes changes of use, including <br />use for augmentation, of the Salazar Ranch water rights (Case No. 07CW42). BMRI proposes to <br />operate in a similar manner and to continue augmenting depletions consistent with that described in <br />the 89CW32 and 99CW057 decrees ("existing augmentation plans "), but use some of the water <br />rights that it is seeking to change in 07CW42 as the augmentation source(s) to replace depletive <br />effects under this Substitute Water Supply Plan (SWSP). Therefore, BMRI is seeking a SWSP under <br />C.R.S. 37- 92- 308(4) while Case No. 07CW42 is pending. <br />BMRI currently replaces depletions associated with well pumping to manage the hydraulic gradients <br />of ground water in the West Pit and Rito Seco alluvium, as well as replacing precipitation and storm <br />water runoff capture, which are fully described in the 99('W057 decree. As part of this SWSP, <br />BMRI is planning to deliver some of the water pumped from the West Pit and alluvial wells to the <br />Tailings Management Facility (TMF), a lined facility with no discharge, where it will he fully <br />consumed. This operation is already approved under the existing augmentation plans. As part of this <br />SWSP, I3MRI is seeking the right to utilize some of the Salazar Ranch water rights to offset <br />depletive effects to Rito Seco. <br />
