Reference Area Management <br />The water in this reference area and all mine reclaimed areas is from the same ditch of the CC <br />Company, thereby eliminating any differences in water availability during the year. The contractor <br />will be required by Western Fuels to apply the waterto the reclaimed areas and the reference area <br />at the same time. Western Fuels owns the reference area and is in charge of the irrigation <br />management of it. The same contractor who manages the reclaimed area will manage the <br />reference area. This is not the case with any other Reclaimed Irrigated Pastureland area within <br />a reasonable distance of the mine permit area. <br />The contractor will release water into the reclaimed area and the reference area from the CCC <br />ditch at the same time. The flood irrigation of the reference area will be regulated to simulate the <br />same plant application rate and conditions of the side roll irrigation of the reclaimed area. Flood <br />irrigation may also be employed in the reclaimed area. The irrigation method in all Reclaimed <br />Irrigated Pastureland reclaimed areas was flood irrigation prior to mining. <br />The expected application rate of water: Water will be applied to the reference area based on the <br />ratio used for the irrigation of Reclaimed Irrigated Pastureland on the Lloyd property. <br />Plans for livestock grazing and haying: The IP reference area will be grazed and /or hayed to <br />simulate the management on the reclaimed irrigated pasture land. The Irrigated Pasture reference <br />area may be grazed by domestic livestock in late June to simulate 1St hay cutting of the IP <br />reclaimed land, but only after any vegetation studies are completed. The intensity of livestock <br />grazing during late June and possibly through the summer growing season will be monitored so <br />overgrazing will not occur that could damage the existing vegetation for the next year growing <br />season. If the IP reference area is not grazed for 1St 2nd or possible 3rd period vegetation harvest <br />removal, then the reference area will be hayed in the same time period(s) and methodology as the <br />irrigated pasturereclamation so both areas are managed similarly. The reclaimed area will have <br />their 1St cutting (hayed) in late June after any vegetation studies are completed. Second and <br />possible third cutting (haying) or grazing of Irrigated Pasture and Reference Area will occur when <br />the fields and vegetation growth economically allow it. Winter grazing by domestic livestock and <br />wildlife may occur on all Irrigated Pasture reclaimed and reference areas. Winter grazing by cattle, <br />deer and elk is common practice and may occur on all areas with supplemental hay provided to <br />cattle by ranchers in February of each year. Domestic grazing animals will be removed from the <br />fields prior to irrigation and spring germination of planted species. Generally, animals will be <br />removed no later than March 30th of each year. <br />Plans for fertilization: Fertilizer may be applied to the reference area and the reclaimed area but <br />must be done at the same time and the same rate per acre on both areas. The application rate <br />will be similarto normal practices in the surrounding area for Reclaimed Irrigated Pastureland. The <br />contractorwill be instructed that this practice must be followed. Fertilizermay not be applied every <br />year.
