Walter Wise <br /> Battle Mountain Resources, Inc. <br /> 333 Clay Street, 42nd Floor <br /> Houston, TX 77002 <br /> Dear Mr. Wise: <br /> Given the current situation at the Battle Mountain site and the State' s <br /> concern for human health and safety, as well as environmental protection, I am <br /> requesting you voluntarily take the following actions: <br /> 1 . Cease discharges to the tailings pond which have cyanide levels <br /> potentially injurious to either human or wildlife populations. <br /> 2. Take immediate steps to reduce cyanide levels in the pond to those <br /> levels which are considered protective of human health and wildlife. <br /> While I do not have the express authority to require this cessation of <br /> activities without consultation with the Mined Land Reclamation Board, I am <br /> requesting you take these actions. <br /> Your cooperation in complying with this request will demonstrate your concern <br /> for the health and safety, as well as environmental protection, of the State <br /> of Colorado. <br /> Thank you in advance for your cooperation. <br /> Sincerely, <br /> MICHAEL B.
