We have included a check for $216.00 to cover the filing fee. <br />DEC 2011 <br />(3L „ w :; <br />e; "e ` ia l Matio n <br />Mining and Safety <br />For this Technical Revision, we are revising the reclamation plan slightly for the Hill - Oakley phase of the <br />mine. This phase was known as the Hill -Eber- Oakley phase when we amended the permit in 2005 <br />(DRMS approval date - 2/11/2005). The mining operations and subsequent reclamation boundaries have <br />changed due to the needs of oil and gas producers on the Fort Lupton mine site. <br />- The Eber property has not been mined and will not be included in any water storage reservoirs. The <br />office and scale are currently located on the Eber property, so the Eber property must remain in the <br />permit limits. Any disturbed vegetated areas will be reclaimed with the approved seed mix. We have <br />attached an updated Exhibit C -3: Mining Plan Map to show this mining revision. <br />A positive change from negotiations with the oil and gas producers is that the TOP Operating oil well <br />(and related pipelines) that were located in the Hill -Eber- Oakley phase has been capped and will be <br />completely removed. With the removal of the oil well from the Hill property, we no longer need to <br />keep an oil and gas operations peninsula in the reclaimed reservoir, so we have changed Exhibit F: <br />Reclamation Map to show this reclamation revision. <br />- The mineable acreage of the Hill -Eber- Oakley phase was approximately 44 acres. With the deletion <br />of the Eber property from mining and the removal of the oil well in the Hill property, the mineable <br />acreage of the revised Hill - Oakley phase is approximately 39 acres. <br />- Finally, in keeping with the reclamation modification approved in TR04, L.G. Everist requests that the <br />reclamation for the Hill - Oakley pit be considered complete in a less than fully vegetated state. L.G. <br />Everist will do the initial seeding on the Hill - Oakley reservoir to ensure erosion control. The City of <br />Aurora would like to take over control of the Hill - Oakley reservoir as soon'as possible, and they are <br />willing to accept the phase in a less than fully vegetated state. <br />As you know, L.G. Everist and the City of Aurora have a Purchase and Sale Agreement in which Aurora <br />has agreed to acquire the water storage reservoirs and properties that make up the Fort Lupton Sand and <br />Gravel Mine. Aurora wants to take over ownership of reclaimed properties as soon as they are released <br />from the DRMS permit. Aurora is willing to accept each reclaimed water storage reservoir of the Fort <br />Lupton Sand and Gravel Mine in a less than fully vegetated state. <br />FL- DRMS- TR- HillOakleyReclamationChange- 120811.doc <br />
