OBSERVATIONS <br />PERMIT #: M- 1976 - 009 -HR <br />INSPECTOR'S INITIALS: BMK <br />INSPECTION DATE: December 9, 2011 <br />1) The Division conducted a pre - operational inspection of the site on 9/12/11. Present during the inspection was <br />Mr. Dan Chavez of Schmidt's construction. <br />2) On June 15, 2011, Schmidt's construction was found in violation of affecting less than 7,000 square feet, <br />outside of the approved affected land boundary within the permit. As part of the corrective action, Schmidt's <br />Construction was supposed to submit an amendment that included the affected area of 7,000 square feet as <br />part of the affected land boundary for the permit. This inspection was to verify the fact that the operator had <br />placed the required affected boundary markers and posted the amendment application sign at the access to the <br />property. The amendment was called complete on November 15; 2011.The decision date is February 12, 2011. <br />3) Prior to the Board hearing, Schmidt's Construction completed all the reclamation work on the affected land .The <br />amendment is to include this very small area to the affected land boundary. No additional warranty will be <br />needed when the amendment is approved. <br />4) As required by the Rule, Schmidt Construction had posted the new affected land boundary markers in the area <br />clearly delineating the new affected area boundary. The required amendment application sign was posted at the <br />access to the property. The operation is in compliance with the Rules and Regulations. <br />Page 2 of 4 <br />
