The Operator may not commence mining and milling activities until <br />the Division receives and approves, through the Technical Revision or Amendment <br />process as determined by the Division, mining and reclamation plans, with <br />associated work plans, which satisfy the requirements of Rules 6.4.4, 6.4.5, 6.4.6, <br />and 6.5. <br />6. The Operator may not commence mining and milling activities until the <br />Division receives and approves, through the Technical Revision or Amendment <br />process as determined by the Division, design specifications certified by a licensed <br />professional engineer for all Environmental Protection Facilities, as required by the <br />Act and Rules, and the Operator satisfies the specific requirements of Rules 7.3 and <br />^r.4. The Environmental Protection Facilities include, but are not limited to, the <br />following: mill building; storage sheds and tanks in which designated chemicals are <br />stored or utilized; tailings facilities; and augmentation pond and its associated <br />pipeline and discharge structure. <br />7. The Operator may not commence mining and milling activities until the <br />Division receives and approves, through the Technical Revision or Amendment <br />process, an updated Exhibit L and financial warranty addressing all applicable <br />requirements of Rule 4, and specifically, but not limited to, Rule 4.2.1(4) regarding <br />reclamation costs associated with the protection of water resources, including costs to <br />cover necessary water quality protection, treatment and monitoring as required by <br />permit, and the Act and Rules. The existing Exhibit L, submitted by the Operator, <br />does not address this issue and is not adequate for approval. <br />8.
