Barton of Wasteline, Inc. discussed with Ms. Kate Pick c3'rcl''df 'eti <br />your office, this letter commits us to the following actions or restrictions on our actions, <br />until such time as we are able to post additional and adequate bond, or perform <br />necessary reclamation actions to reduce the cost of remaining reclamation work to the <br />amount of the bond posted: <br />(1) We will not disturb any additional land. At present, the total estimated disturbed <br />area is 0.62 acres. Specifically: <br />a. The existing house pad disturbance (near the south end of the property) <br />will not exceed 1,000 SF (current estimated disturbance). <br />b. The lower and upper roads will be limited to the estimated current <br />disturbed area of 8,300 SF. <br />c. The disturbed area for the storage cove and the parking and loading pad <br />area will not exceed the current area (estimated at 17,850 SF). <br />(2) We will limit the depth of excavation and removal of materials to the following <br />average depths (measured from the original ground level): <br />a. Cove area (estimated at 4,150 SF area, rim to rim): maximum 32 feet. <br />b. Parking and loading pad (estimated at 13,700 SF area, rim to rim): <br />maximum 15 feet. <br />(3) We will limit the side slopes of excavation in the 10,100 SF (estimated area) floor <br />of the parking and loading pad to 3H:1 V. <br />The above limits are intended to limit the cost of reclamation, by limiting the total <br />affected area to 0.89 acres (including areas which will be used as borrow at the top of <br />the existing highwalls) and by requiring only the most economical reclamation work be <br />done, so that the total material required to be moved to reclaim the existing disturbed <br />area is no more than 4,900 CY of earth. <br />At the same time, we also commit to the following: <br />(1) Reporting frequently on the activities. <br />(2) Reclaiming to final configuration, including revegetation of all areas in which <br />construction is now completed or can be without more disturbance, to reduce <br />the total affected area. <br />
