Summary <br />The Review Process <br />Submittal of Application <br />Permit No. C was issued on November 16, 1981, and has been renewed every <br />five years, since then.., <br />For the current renewal, the Division notified Chevron Mining by letter on January 26, <br />2011 that its permit for the Edna Mine would expire on November 16, 2011.,The letter <br />explained that, for operations to continue beyond that date, Rule 2.08.5(3)(f) requires an <br />application for renewal to be received on or before May 20, 2011. Chevron Mining, Inc. <br />submitted a renewal application on May 12, 2011, and it was found complete on May 20,. <br />2011. <br />C1980 -001 Edna Mine Permit Renewal No. 6 <br />Chevron Mining published a notice of the application in the Steamboat Pilot and Today <br />for four consecutive weeks: June 5, 12, 19, and 26, 2011. <br />Comments and Objections <br />No objections regarding the application were received. <br />Applicant Violator System Queries <br />The applicant violator system (AVS) was queried on July 27, 2011. In regard to <br />compliance history, the recommendation of the system was to issue this permit renewal. <br />Chevron Mining, Inc. provided updated ownership and controller information as <br />requested by the Division. Follow -up AVS queries on October 7, 2011, November 29, <br />2011, December 5, 2011 and December 6, 2011, also resulted in recommendations to <br />issue this renewal. AVS checks conducted on November 29, 2011 and December 5, 2011 <br />found some disagreement between officer and director information provided by the <br />operator. The AVS check conducted on December 6, 2011 found all officers and <br />directors information concurrent with information provided by the operator. <br />Division Adequacy Review and Timeframes <br />The Division identified three adequacy items regarding the application for renewal. These <br />items were an update of the Identification of Interests (Rule 2.03.4), documentation of <br />consultation with the local weed control agency (Rule 4.15.1(5) and permit commitment), <br />and resolution of acreage reporting discrepancies. Chevron resolved all of the identified <br />adequacy items. The Division proposes to approve the renewal application. <br />Publication of this proposed decision initiates a thirty -day public comment period. <br />Provided there are no objections to the decision, it becomes final at the close of the <br />comment period. <br />
