1. The activities proposed by the applicant will not interrupt, discontinue, or <br />preclude farming on the alluvial valley floors that are irrigated or naturally <br />subirrigated [Rule 4.24.3(1)]. <br />2. The proposed activities will not materially damage the quantity or quality of <br />water in the surface or ground water system described above [Rules 4.24.3(3) <br />and 2.06.8(5)(a)(ii)]. <br />3. The proposed activities will comply with the requirements of the Act and the <br />Regulations with respect to alluvial valley floors [Rule 2.06.8(5)(a)(iii)]. <br />4. Surface coal mining and reclamation operations will be conducted to preserve <br />the essential hydrologic functions of alluvial valley floors outside the permit <br />area and to reestablish the essential hydrologic functions of alluvial valley <br />floors within the affected area throughout the mining and reclamation process <br />([Rule 4.24.2). <br />5. An environmental monitoring system has been installed, and shall be <br />maintained and operated by the permittee on all alluvial valley floors during <br />surface coal mining and reclamation operations and continued until all bonds <br />are released in accordance with Rule 3 (Rule 4.24.4). TR48 approved <br />discontinuation of monitoring of the alluvial wells. Chevron Mining Inc. sealed <br />the monitoring wells in September 2009. <br />Oak Creek AVF <br />During the review of the original application for the Edna Mine permit, the Division <br />determined that Oak Creek was an AVF. Chevron applied for, and the Division approved <br />Permit Revision No. 3 to declassify Oak Creek, where it is immediately adjacent to the <br />eastern permit boundary, as an alluvial valley floor as defined in Rule 1.04(10). The area <br />that is no longer classified as an AVF extends from the southeastern permit boundary <br />north to and including the Routt County Road 179 crossing over Oak Creek. This area <br />includes the NE'/ Section 19; NW'/ Section 20; W %2SW % and W %2SW' /NW'/ Section <br />17, Township 4 North, Range 85 West of the 6th Principal Meridian. The limits of <br />declassification are defined on Exhibits 4.6 -10 and 4.6 -11 in the Edna Mine PAP. <br />Portions of Oak Creek upstream and downstream of this area remain a designated AVF. <br />The Edna Mine would have little or no impacts on the Oak Creek AVF because the AVF <br />is upgradient from Edna's ground water flows and would receive only occasional, <br />neglible surface water runoff from the mine. <br />C1980 -001 Edna Mine Permit Renewal No. 6 31 <br />
