Hickenlooper <br />Governor <br />Mike King <br />December 5, 2011 Executive Director <br />Dick Wolfe, P.E. <br />Director /State Engineer <br />RE: Substitute Water Supply Plan for DeBeque Pit <br />DRMS #M -81 -058 ✓ <br />Sections 8 & 9, T9S, R97W, 6th P.M. <br />Water Division 5, Water District 72, Mesa County <br />Approval Period: May 17, 2010 through April 30, 2012 <br />Contact Phone Number for Mr. McLean: 303 - 651 -1468 <br />Dear Mr. McLean: <br />We have reviewed your March 30, 2010 and March 1, 2011 letters . requesting renewal of the <br />substitute water supply plan ( "SWSP ") for the DeBeque Pit on behalf of Kirkland Construction, RLLP <br />( "Kirkland" or "Applicant "), in accordance with § 37 -90- 137(11), C.R.S. The required fee of $257 for the <br />renewal request has been submitted (receipt nos. 3645225 and 3649317). The original plan was <br />approved on June 3, 2003 and it was most recently renewed on April 28, 2008. <br />SWSP Operations <br />This SWSP seeks to replace depletions resulting from mining operations at the DeBeque Pit. <br />The depletions that result from the mining operations are evaporation from exposed ground water, <br />water lost in the mined product, and water used for dust suppression. The mine is located in. Mesa <br />County in the SE1 /4 of Section 8, and the SW1 /4 of Section 9, Township 9 South, Range 97 West of <br />the 6 P.M. After mining operations are completed, the site will be reclaimed as an unlined ground water <br />pond with a surface area not to exceed 11.6 acres and with a net depletion of 27.62 acre -feet during the <br />April through October call period. Currently there are 3.6 acres of ground water exposed at the site. <br />Evaporation losses from the 3.6 acres of exposed ground .water are replaced by a plan for augmentation <br />that was decreed in case no. 2005CW076. This SWSP will replace depletions that result from the on- <br />going mining operation and the exposure of additional ground water (in addition to the 3.6 acres <br />previously exposed). The existing 3.6 acre pond will be contiguous with the added pond area. The <br />proposed sources of replacement water for this pit are 38.7 acre -feet of historical net stream depletions <br />during April through October from the dry-up of 19.1 acres of land historically irrigated with 6.1 shares of <br />the Larkin Irrigation Company ( "Larkin Ditch "). The post mining depletions will also be covered by the <br />dedication of the 6.1 shares in the Larkin Ditch. <br />In accordance with the letter dated April 30, 2010 (copy attached) from the Colorado <br />Division of Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining operators <br />must comply with the requirements of the Colorado Reclamation Act and the Mineral Rules and <br />Regulations for the protection of water resources. The April 30, 2010 letter from DRMS requires <br />that you provide information to DRMS to demonstrate you can replace long term injurious <br />stream depletions that result from mining related exposure of ground water. The DRMS letter <br />identifies four approaches to satisfy this requirement.
