DEPARTMENT OF NATURAL RESOURCES / ' /
DIVISION OF WATER RESOUR
Response to Reclamation Permit Application Consideration
DATE: / December 6, 2011 hichael ichael A. Cunningham, Environmental Protection Specialist
CC: Division 1 Office, District 1 Water Commissioner RtCEfVE )
FROM: Tracy Kosloff, P.E. 'EC 07 211
RE: Chartier Pit, Permit No. M- 1984 -040
Operator & Contact: Larry L. Chartier, 970 - 842 -5657 Divialon of Reclamation,
Sec. 14, Twp. 4N, Rng. 65W, 6th P.M., Weld County TV Mining & Safety
COMMENTS: The amendment seeks to add 1.5 acres to the permitted area, for a total of 9.9 acres. There are
no other changes from the original DRMS permit listed in the application.
Well permit no. 73613 -F allows for a total surface area of the ground water pond in Chartier Pit of 8.5 acres, or
the amount covered under a water court approved plan for augmentation or substitute water supply plan
(SWSP), whichever is less. From the submittal, it seems likely that more than 8.5 acres of ground water will be
exposed in the future. In that case, a new well permit is required. If less than 8.5 total surface acres of ground
water will be exposed under the proposal, please provide a clarification to this office.
Depletions from the Chartier Pit are currently replaced through a SWSP operated by the Colorado Division of
Wildlife. The SWSP specifically replaces depletions from evaporation of 8.5 acres of exposed ground water as
well as the first fill and some water loss in mined product. This proposal may result in additional depletions that
would need to be replaced and should be described in a revision to the SWSP.
Office of the tate Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303 - 866 -3581 • Fax: 303 - 866 -3589
www.water.state.co.us
John W.
