Adequacy Review of 112 Construction Materials Reclamation Permit Technical Revision

On December 1, 2011 the Division of Reclamation, Mining and Safety (DRMS) reviewed the Whitewater
Building Materials Corporation (Operator) application for a 112c Construction Materials Reclamation
Permit Technical Revision for Pit 500, Permit No. M- 1977 -129. A review of Whitewater Building
Materials Corporation's request has revealed a few issues and clarifications that need to be addressed.
Stage 2B
1. Please provide documentation in the form of a signed affidavit from Colorado Dept. of Public
Health and Environment: Water Quality Control Division and/or Colorado Division of Water
Resources that demonstrates that the practice of adding surface water from East Creek to the pond
water is in compliance with all applicable water rules and regulations.
2. What methods of stabilization will be implemented at the inlets to prevent "cut back" erosion of
the slopes? Evidence of "cut back" was observed at the eastern inlet pipe during the June 2, 2011
inspection.
Stage 3B
1. Please provide a copy of the agreement between the Operator and Mesa County that demonstrates
that Mesa County accepts to reclaim the area disturbed per the requirements of the approved
reclamation plan.
General
1. The final paragraph states that since the changes in reclamation in Stages 2A and 2B are
landowner driven the Operator has no obligation to maintain or upkeep improvements. To
clarify, the Operator is not required to maintain or upkeep facilities owned by a separate party
(i.e. Irrigation system, bike track, storage building etc.) but the Operator is responsible to insure
that reclamation is completed to the requirements of the approved reclamation plan and to follow
the performance requirements of the Construction Materials Rules and Regulations.
The decision date for this application has been set for December 28, 2011 provided all issues have been
addressed. To allow adequate time for staff review the applicant should submit a response no later than
December 14, 2011. If a response or request to extend the decision date is not received by December 14,
2011 or the application may be denied.
