Mr. Marty McHugh
Gold Eagle Mining, Inc.
845 East Main Street
Montrose, CO 81401
Dear Mr. McHugh:
Department of Energy
Washington, DC 20585 ( L', 7 7
Ai tot 3 /
AA" t 7dr
December 1, 2011
ar y G•r OR !•"•A"O
pR
DEC 0j2011
Divisiv:
--J
The U.S. District Court's Order of October 18, 2011, in Colorado Environmental Coalition v.
Office of Legacy Management, Civil Action No. 08 -cv -01624 (D. Colo.), issued injunctive relief
regarding the Department of Energy's (DOE) uranium leasing program (ULP). The district court,
among other things, stayed all of the ULP leases, and hence all activities on the leaseholds,
including actions by you as lessee or your agents. DOE has committed to notify the court if we
learn of any documents or communication or other circumstances that might require activities
on the ULP lease tracts. Because of that Order, it is particularly important that you provide the
Department, as required by Paragraph XVIII, "Reporting Requirements," in your ULP lease, with
copies of all orders, permits, and correspondence that might require you to take action on your
ULP lease tract. Furthermore, given the broad injunction entered by the court, we must also
request that you not initiate any activities on your ULP lease tracts in response to those orders,
permits, and correspondence or otherwise.
In the event that you do receive orders, permits, and correspondence that might require you to
take action on your ULP lease tract we request that you notify DOE of them. DOE will inform
you whether such proposed activities are permitted by the Court. We will make every effort to
respond to you as quickly as possible.
DOE recognizes that there are other authorities that may direct actions on your lease sites; we
appreciate your interest in complying with direction received from other government agencies.
DOE has sought clarification from the U.S. District Court regarding the scope of the injunction
contained in the Court's Order. Pending clarification, we are reemphasizing that the Order
Printed with soy ink on recycled paper
