driveway, they were very helpful and responsible. They installed a culvert and gravel to <br />reinstate the driveway and help mitigate further erosion. The circumstances he detailed tonight <br />are simply an attempt to truthfully convey how the project was affecting their family. The rock <br />picking and stockpiling project has become a serious impediment to the enjoyment of the area <br />they were so attracted to over 60 years ago. <br />Mr. VanZandt asked Mr. Johnson what the view was like when he looks out and sees the <br />construction equipment, and if it was fully visible. Mr. Johnson replied it was partially visible, <br />noting there are some trees on the south end of the property that screen some of it, but it's not <br />the view so much as the noise. Mr. Griego referred to Exhibit 7B of staffs review and asked Mr. <br />Johnson if that was his property, and Mr. Johnson replied yes. Mr. Griego asked Mr. Johnson if <br />right next to his property in the area in front is where they keep the equipment and the boulders, <br />and Mr. Johnson replied yes. Mr. Griego asked Mr. Johnson if that was his front door looking <br />straight across, and Mr. Johnson replied yes. Mr. Johnson stated when the Barickmans bought <br />the property a few years ago, they were going to build a house on the land directly south of his <br />property, which was abandoned for various reasons. He assumes their future building plans are <br />going to be west, which is where the rock mining operation is, so they would be back in the <br />trees close to the Greenhorn Trail. He questioned if Mr. Barickman was planning to build his <br />home on the original area. Acting Chair Ozzello replied they would have Mr. Barickman answer <br />that question when he comes back for rebuttal. Mr. Raso stated they would have him answer <br />that question for the record. <br />Mr. Bob Blazich, 2035 Lynwood, spoke in opposition to the special use permit. He reported he's <br />a former landowner in Rye. One question they need to ask is if they would be doing any <br />blasting, noting that's his main concern for the land up there. <br />Mr. Mark Vivoda, 903 Starlite Drive, Pueblo, spoke in opposition to the special use permit. He <br />reported he has 100 acres at 10369 Linger Longer Lane and recently purchased another 40 <br />acres at 10327 Linger Longer Lane, which is adjacent to Zorn Road. One of his primary <br />reasons was to keep it from being subdivided, noting it's in an agricultural zone district and he <br />does a lot of hay. He doesn't know if he's in direct opposition of Mr. Barickman's rock gathering <br />operation, but one of his concerns is whether it's going to affect any of the water or water rights <br />on his property. He's been in Rye for 53 years and is familiar with the property. His neighbors <br />run a few head of cattle, noting they kept getting into his hay fields and he had to get them out <br />of there, not so much for what they were eating, but he didn't want them to bloat. He's familiar <br />with Mr. Barickman's property and he's been up there numerous times. His major concern is <br />the water. If there's going to be any subdivision, excavation, or any other detrimental effects to <br />the water being diverted from the normal drainage, that's his concern. It's been a bad year, <br />noting he's been without domestic water for several years. As Mr. Gagliano mentioned, there's <br />a canopy of trees. The excavation of the boulders and the tree removal is going to affect the <br />ground water, the water shed, the underground water, and the water table. He's not close <br />enough to hear the noise and see the dust from his Zorn Road property, but there are a lot of <br />concerns from the people that drive the area, noting they want him to cut brush off the corner of <br />Linger Longer Lane and Zorn Road. They were especially concerned when the initial route for <br />the semis was going to be down Zorn Road at the bottom of the hill. There haven't been any <br />accidents there, but those were some of the concerns. His concerns are the water, the <br />underground water, the water shed, and any subdivided excavation. <br />Mr. Barickman rebutted the testimony. He reported all he can go on are the review and <br />recommendations from the City-County Health Department and the other four or five agencies <br />that signed off on it.
