(CDOT) about the haul road going through the Town of Rye onto Highway 165. They have <br />excellent sight distance both ways so there were no negative comments from CDOT. The <br />Colorado Division of Wildlife also indicated there was nothing abnormal. Mr. Barickman needs <br />to get rid of the rocks and it's a low impact operation. <br />Mr. Clark asked Mr. Gagliano to clarify if the applicant owned 217 acres and if the application <br />was for 61.2 acres with the reclamation being done in stages of not more than 9.9 acres. Mr. <br />Gagliano replied yes, noting it would be the limit of the reclamation permit. Mr. Clark asked Mr. <br />Gagliano if it was for residential use. Mr. Gagliano replied yes, after the rocks are cleared. Mr. <br />Clark asked Mr. Gagliano how big the footprint was of the house they were clearing for. Mr. <br />Gagliano replied he would have to ask Mr. Barickman. Mr. Leverington asked Mr. Gagliano how <br />long the rock picking operation had been going on, and Mr. Gagliano replied two years. Mr. <br />Leverington asked Mr. Gagliano if they had received any complaints from the public. Mr. <br />Gagliano replied he hadn't heard of any. Mr. Leverington asked Mr. Gagliano if there were any <br />public safety issues, and Mr. Gagliano replied no. <br />Mr. Donald Banner, Attorney, 503 North Main Street, Pueblo, spoke in favor of the special use <br />permit. Mr. Kim W. Barickman, 8140 Zorn Road, Rye, spoke in favor of the special use permit. <br />Mr. Banner directed his questions to Mr. Barickman. He asked Mr. Barickman how long he had <br />lived in Rye, and Mr. Barickman replied a little over 25 years. Mr. Banner asked Mr. Barickman <br />when he purchased the land that was subject to the special use permit, and Mr. Barickman <br />replied approximately four and a half years ago. Mr. Banner asked Mr. Barickman what the <br />purpose was for purchasing the property, and Mr. Barickman replied on which to build a home. <br />Mr. Banner asked Mr. Barickman if the land was zoned A -1, and Mr. Barickman replied yes. Mr. <br />Banner asked Mr. Barickman if it was legal to build a single- family residence in an A -1 Zone <br />District, and Mr. Barickman replied yes. Mr. Banner asked Mr. Barickman if there were other <br />homes in the area, and Mr. Barickman replied yes. Mr. Banner asked Mr. Barickman how many <br />there were and how close they were to his property. Mr. Barickman replied there were three <br />homes that were close to his property plus a lodge that was a recreational place for people. Mr. <br />Banner asked Mr. Barickman if there were additional homes within a half -mile radius, and Mr. <br />Barickman replied yes. Mr. Banner asked Mr. Barickman how many, and Mr. Barickman replied <br />ten. Mr. Banner asked Mr. Barickman what characteristics about the land he purchased <br />prompted him to buy it, and Mr. Barickman replied it's remote, heavily wooded, and a river runs <br />through it. Mr. Banner asked Mr. Barickman if there were 217 acres, and Mr. Barickman replied <br />yes. Mr. Banner asked Mr. Barickman if he selected the area he wanted to build his home on, <br />and Mr. Barickman replied yes. Mr. Banner asked Mr. Barickman if the parcel was less than ten <br />acres, and Mr. Barickman replied yes. Mr. Banner asked Mr. Barickman how big the home <br />would be that he was proposing to build. Mr. Barickman replied it depended on the economic <br />conditions, but the other three homes he was involved with were 8,000 to 10,000 square feet. <br />Mr. Banner asked Mr. Barickman if the rest of the land would be used for his yard or gardens. <br />Mr. Barickman replied it would be used for pathways, yards, hiking trails, and snow - shoeing. <br />Mr. Banner asked Mr. Barickman if the total area he wanted to remove rock from was less than <br />ten acres, and Mr. Barickman replied yes. Mr. Banner asked Mr. Barickman if prior to him <br />engaging in removing the rock himself if he got any bids to remove the rock so the property <br />could be used to construct a home, and Mr. Barickman replied yes. Mr. Banner asked Mr. <br />Barickman who that was, and Mr. Barickman replied Siegel Concrete. Mr. Banner asked Mr. <br />Barickman if they gave him a bid. Mr. Barickman replied it was open- ended and exceeded <br />$250,000. Mr. Banner asked Mr. Barickman if the bid to remove the rock in the area less than <br />ten acres was a minimum of $250,000, and Mr. Barickman replied yes.
