PERMIT #: M -1981 -022 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: November 22, 2011 <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Larry Johnson, John Warren and Brandon Martin were present on behalf of Connell Resources, Inc. <br />The Glass Gravel Pit is located 1/2 mile north of Fort Collins, Colorado. The site is permitted for 15.4 acres and <br />the post- mining land use is recreation. <br />The Division received a request for a Surety Reduction on September 26, 2011. The Division sent out notices <br />regarding the Surety Reduction request to the owners of record of the affected land, the Larimer County <br />Commissioners and to the Fort Collins Conservation District on September 29, 2011 as required by <br />Construction Materials Rule 4.17.2. The Division did not receive any written objections to the Surety Reduction <br />request. <br />Reclamation Success: <br />The Division conducted a prior inspection of the site on July 28, 2010 at which time the Division cited a <br />problem for failure to complete reclamation within five years from the date mining ceases. The Operator was <br />given until July 28, 2011 to complete reclamation of the site. The Operator is still in the process of completing <br />reclamation and will need to request an extension of the corrective action date in writing to the Division by <br />December 31, 2011. <br />On January 4, 2011, the Division approved Technical Revision No. 2 (TR2). Under TR2, the Reclamation Plan <br />was revised to eliminate the construction of a dry clay -lined 4 acre depression. The Operator will backfill the <br />areas with exposed groundwater and the entire site will be reclaimed to a post- mining land use of general <br />agriculture. The area of exposed groundwater is located in the southeast corner of the site and is <br />approximately 1 acre in size and 10 ft. deep. The Operator is importing fill material from a nearby operation <br />and has provided the Division with an affidavit certifying the material is clean and inert as required by Rule <br />3.1.5(9). The following reclamation tasks remain to be completed: <br />1. Import fill material (^'24,200 cy) <br />2. Backfill area with exposed groundwater <br />3. Replace topsoil <br />4. Revegetate disturbed areas <br />Once the above reclamation tasks are completed the Operator may file a written notice of completion of <br />reclamation and request for release of reclamation responsibility in accordance with Rule 4.17.1. <br />Financial Warranty: <br />The Division currently holds a financial warranty in the amount of $148,500.00. The Operator has requested <br />that the financial warranty be reduced to $79,626.00. Following this inspection, the Division will recalculate <br />the amount of the financial warranty. Notice of the Division's decision regarding the Surety Reduction request <br />will be sent under separate cover. <br />This concluded the inspection. <br />Page 2 of 4 <br />
