Pirleda <br />Golden, CO 80401 Director <br />/ v <br />Re: Wray Mesa Project, Receipt of Modification MD -1 of Prospecting NOI, File No. P -2011 -025, <br />Bond Amount is Sufficient, Modification is Approved. ,j <br />Dear Mr. Leidich, <br />The Division received the modified Notice of Intent to Conduct Prospecting (NOI) named above on <br />November 10, 2011, and the non - confidential contents of it were posted on the Division's website in <br />accordance with the requirements of Rule 5.1.3, on November 14, 2011. Any public comment or request <br />for disclosure of information designated as confidential regarding the NOI must be received by the <br />Division no later than the deadline of ten (10) days after the notice was posted on the Division website. <br />As of November 25 (deadline was extended one day for the holiday) no such request had been received. <br />The Division has reviewed Modification MD -1 of the NOI and has found no deficiencies or any <br />indication that the proposed operations are considered to be mining rather than prospecting. The amount <br />of disturbance proposed under this modification is equal to the amount and types of disturbance <br />previously approved, and for which an adequate bond was already submitted and accepted. <br />The Division currently holds a bond in the amount of $8,163 for this project. Review of this modification <br />shows that no bond increase is necessary for this modification. Therefore, the posted bond is sufficient, <br />and you are approved to proceed with the activities proposed in this modification.
