TO ROB ZUBER <br />FROM: JANET BINNS <br />SUBJECT: MARRMINE C1980 -006, TR25 <br />DATE: 11/30/2011 <br />CC: DAN HERNANDEZ <br />INTEROFFICE MEMORANDUM <br />I have reviewed Kerr Coal Company's (KCC) TR25 application. TR25 proposes to revise the currently <br />approved reclamation success vegetation species diversity standard. The intent of the proposed diversity <br />revision is to more closely reflect the diversity measured in the reference areas. <br />There are two reference areas used for comparison for reclamation success in the Marr Permit. The Tipple <br />reference area is used specifically for comparison to the reclaimed Tipple area for reclamation success. The <br />Tipple (11.7 acres) and Tipple Reference area are located south of the town of Walden, in the Illinois River <br />bottomland. The remaining portions of the Marr Mine, consisting of approximately 8 acres, are located <br />approximately 12 miles east of the town of Walden, on upland rangeland west of the Canadian River <br />drainage. The Mine area previously used a weighted acreage method of reclamation success comparison, and <br />evaluated vegetation on more than one reference area (four reference areas) located near the mine site to <br />determine reclamation success. However, since the remaining parcels at the mine area exhibited only one <br />vegetation community prior to disturbance, the operator has requested that only the Alkali Sage Reference <br />area be used for reclamation success comparison for the remaining parcels at the mine site. The Division <br />concurs with this request. <br />KCC proposes a diversity standard for the Mine area reclamation; <br />• The reclaimed plant community must consist of at least 5 species possessing at least 3% relative <br />cover. <br />• One of the five species, one must be a forb or a shrub species. <br />• The four dominant species shall not contribute less than 63.5% or more than 87.89% of the total <br />relative cover, <br />• No single plant species shall contribute more than 50% relative cover. <br />• The calculation of the species diversity values can be made using either data collected from either the <br />first or second year of Phase III vegetation sampling period individually, or by averaging the data <br />from the two monitoring periods into an average percentage relative plant cover value. <br />1. The Division is unable to accept the last bullet point for reclamation success comparison. Rule 4.14.7(5) <br />specifically states, "The revegetation success criteria as defined in relevant subsections of 4.15, shall be <br />met for at least two of the last four years of the liability period."
