The <br />weather was clear and warm. The mine site and region were dry. The inspection began with visiting Ron <br />Thompson of New Elk Mining, Inc. at the New Elk offices in Trinidad. The inspection then progressed to the <br />mine site. Mr. Jim Stover, representing New Elk Mining, Inc. met the inspectors at the mine site. TK Mining is <br />the operator on the mine site. <br />EXCESS SPOIL and DEVELOPMENT WASTE — Rule 4.09 Placement; Drainage Control; Surface <br />Stabilization: <br />TK Mining continues to develop mains to the Allen seam as approved by the mining plan. Development <br />waste is currently being disposed of in the approved development storage piles. TK Mining plans to dispose of <br />coal mine waste in the currently approved refuse pile (RDA). <br />Mr. Stover discussed the plan to bring waste to the east of the current development waste pile, adding an <br />additional conveyor to convey to waste over the highway, and dispose of material on the RDA. The Division <br />believed that the access road will need to be permitted as a haul road from the eastern edge of the current <br />development waste pile to the transfer building /conveyor. This will necessitate submittal and approval of a <br />Technical Revision. <br />EXPLOSIVES — Rule 4.08 Distance Prohibitions 4.08.4; Warnings 4.08.4; Control of Adverse Effects 4.08.4: <br />The explosives storage area is bermed /gated and appropriate signage has been erected. Run off from the <br />explosives storage area drains to a low point within the explosives storage area berm. This low point does not <br />have a great amount of elevation difference to the point that excess runoff could flow into the clean water <br />diversion ditch. TK Mining needs to assure that runoff from the explosives storage area cannot flow into the clean <br />water diversion without appropriate treatment. <br />OTHER (SPECIFY): <br />Number of Partial Inspection this Fiscal Year: 4 <br />Number of Complete Inspections this Fiscal Year: 1 <br />Page 2 of 6 <br />
