The bond release <br />application was found complete by this Division on November 25, 2011. The Mountain Coal <br />Company, LLC (MCC) has submitted a Partial Phase II Bond Release for the West Elk Mine. The <br />Bond Release application is for lands reclaimed between 1996 and 2007, including vent shafts <br />locations, drill holes, drill pads and roads. The specific sites are listed in the Partial Phase II Bond <br />Release application SL -04. MCC is requesting a Partial Phase II Release for 67.6 acres. The amount <br />MCC is requesting for release for the Phase II areas for topsoil replacement and reestablishment of <br />vegetation will be determined following the application evaluation and site inspection. The Division <br />will review the Bond Release application. and the applicable areas to determine if the Phase II Bond <br />Release criteria have been met. Based on the Divisions review, the Bond Release amount will be <br />calculated and the Bond Release acreages may be adjusted. The 'surface ownership is Federal and <br />private, and the coal mined was Federal and private. <br />We will contact you to advise you of the Division's required bond release inspection of the site as soon <br />as it has been scheduled.
