Box 591 <br />Somerset, CO 81434 <br />Re: West Elk Mine (Permit No. C- 1980 -007) <br />Bond Release Application No. 4 (SL -4) <br />Dear Ms. Welt: <br />The Colorado Division of Reclamation, Mining and Safety has deemed Partial Phase II Bond Release <br />SL -04 for the West Elk Mine (Permit No. C -1980 -007) complete on November 25, 2011. Pursuant to <br />Rule 3.03.2(2) of the Rules and Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining, the Division shall "...within thirty (30) days or as soon thereafter as the Division determines <br />weather conditions permit, conduct an inspection and evaluation of the reclamation work involved..." <br />Given the current weather conditions at the West Elk Mine and the areas requested for release, the <br />Division will postpone . this inspection until weather conditions permit. The Division anticipates <br />performing the inspection in late spring or early summer 2012.
