TMI is requesting Phase II bond release on the following <br />parcels; A -C -05, F- AB -05, F- AB -06, Z -AB -05 and Z- AB -06. These parcels were seeded in 2005 and <br />2006. The requested areas were sampled for revegetation success in 2010. <br />For the parcels requested for Phase II bond release, the post mine land use is designated as rangeland. <br />The required topsoil replacement depth is 12 inches plus or minus 2 inches (permit page 4 -256). TMI <br />verifies topsoil replacement depth by load counts. Based on the SL12 submittal this was done for all <br />the requested parcels except for parcel A -C -05. According to the bond release application, the <br />Division verified the topsoil depth during the October 12, 2005 inspection for this parcel. Also, the <br />Division's November 21, 2008 "Findings of Compliance and Proposed Decision for Phase I (Partial <br />Bond Release; SL -08," indicates the topsoil depth for parcel A -C -05 was either verified in the <br />Division's October 12, 2005 or October 24, 2007 inspections reports. However, based on my review <br />of these inspection reports, neither of them indicated parcel A -C -05 was sampled by the Division for <br />topsoil depth. Load count numbers were not provided in the SL12 application for this parcel. Given <br />this, parcel A -C -05 does not appear to have been verified for topsoil replacement. All other parcels <br />included in the SL12 release request had verified topsoil depths.
