Heifner, Ecologist <br />37 East Colorado Avenue • Denver, Colorado 80210 -3105 • (303) 906 -8096 <br />In accordance with the rules and regulations governing mining in the State of Colorado, the attached public <br />notice is being provided to you. You are an owner with property adjacent to or within 200 feet of the <br />affected land boundary for Schmidt Construction Company's Menzer Quarry. Schmidt has applied for a <br />very small amendment the permit and notification adjacent or nearby owners is required by law. - <br />This amendment adds a small parcel of land (6,762 square feet) on the east side of the operation where <br />there was an inadvertent spillage of rock beyond the affected land boundary. The affected land boundary is <br />the limit for surface disturbance in the course of mining the property. By rule, additions of affected land <br />require an amendment to the permit. No actual mining was conducted in the amendment area, but because <br />the land was disturbed and rehabilitated it must be added to the permit as an addition of affected land. All <br />of the rehabilitation work was completed in early August and accepted by the Division of Reclamation, <br />Mining, and Safety as well as the Colorado Mined Land Reclamation Board. Normally, work on <br />amendment areas is done after approval of the amendment as most amendments involve additional mining <br />in the amendment area. In this case, to limit increased impact on the local environment, rehabilitation was <br />needed prior to the amendment process. The Division authorized this approach. If you have comments on <br />the amendment application, the contents of the amendment can be viewed at the locations listed in the <br />public notice.
