DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866 -3567
FAX: (303) 832 -8106
November 23, 2011
Daniel Bear
Bear Coal Company, Inc.
1326 War Emblem Lane
Rock Springs, Wyoming
82901 -7713
Mined Land Reclamation
RE: Bear No. 3 Mine, Permit No. C- 1981 -033, Bear Coal Company
Technical Revision No. 29, Treatment Pond Bypass Pipeline, Adequacy Review
Dear Mr. Bear:
STATE OF COLORADO
The Colorado Division of Reclamation, Mining and Safety (Division) has completed its
adequacy review of Technical Revision No. 29 (TR -29) for the Bear No. 3 Mine. The Division
has the following comments and questions:
1. On Drawing 11 -4, please add a note that the pipelines from the treatment pond and the
pipeline that is proposed in TR -29 are buried.
2. Please consider realigning the intersection of the bermed ditch and the proposed pipeline
so that there isn't a sharp 90 degree turn, as is shown on Drawing 11 -4.
3. In the Pond Inlet Detail on Drawing 11 -4, please explain the meaning of the statement
"Gravel Pad Remaining after Reclamation ". The Division is not aware of any gravel pad
that is permitted to remain after reclamation.
4. In both the Primary Spillway Detail and the Emergency Spillway Detail on Drawing 11-
4, there is a designation of the "Sediment Pond Level" shown where the buried pipeline
from the treatment pond goes down in elevation and then back up. Please explain what
this designation represents and whether or not the buried pipeline actually dips down and,
then, back up.
5. On proposed revised pages 2.05 -ii and 2,05 -23, please add that the CDPHE approval and
a revised NPDES permit will also be obtained before the bypass pipeline is put into
service.
6. The last sentence on proposed revised page 2.05 -23 states that the pond's design
parameters can be found on page 11 -14. The Division's copy of the permit application
does not include a page 11 -14. Please provide a copy of page 11 -14.
COLORADO
D I V I S I O N O F
RECLAMATION
MINING
— &—
SAFETY
John W.
