OBSERVATIONS <br />PERMIT #: M -1986 -085 <br />INSPECTOR'S INITIALS: ECS <br />INSPECTION DATE: November 18, 2011 <br />This was a site inspection conducted by Eric Scott of DRMS for The Weaver Quarry site as a routine monitoring <br />inspection, and also to inspect the existing conditions of the site with respect to the succession of operator (SO) request <br />submitted to the Division on September 26, 2011. The DRMS representative visited the site at approximately 1000. <br />Weaver Quarry is operated by Loukonen Brothers Stone. Although there were several laborers present and working at the <br />time of the inspection, DRMS was unable to speak with them due to language issues. The site entrance is located on the <br />north side of Larimer County Road 27 immediately southwest of Mansonville, and is accessed via a private gate. The <br />required site entrance posting was present, although it was badly weathered and should be replaced. <br />The Weaver Quarry is adjacent to the Starks Quarry (M2001 -114) which is also operated by Loukonen Brothers Stone. <br />The markers delineating the boundary between the two sites were not able to be located, nor was the eastern boundary, <br />and this has been noted in the problems section of this report along with a corrective action and due date. DRMS was also <br />unable to determine if the area that fresh stone was being stockpiled (Photo 2 - on the east side of the entrance road) is <br />actually part of the permitted area, however it seems unlikely based on the current map provided to DRMS with the last <br />annual report. All land affected by mining activities including stockpile areas and haul roads must be included in the <br />permit area. Failure to do so may result in a violation for failure to protect off -site areas from mining impacts, or an "out - <br />of- bounds" violation. It was also apparent during the inspection that the two sites were being mined and operated as a <br />single entity, which could also result in possible permitting violations. DRMS would be willing to meet with the operator <br />to attempt to resolve these issues through a permit amendment or other appropriate permitting or operational mechanism <br />when the succession of operator process has been completed. A good first step would be to clearly delineate the site <br />boundary on a site photo (such as from Google Earth or similar), or some other map that makes it clearly identifiable <br />where all permit boundaries are located. <br />Although due to the lack of boundary markers it is unable to be certain, it appeared that a significant portion of both <br />permit areas has been disturbed at this time and has not been reclaimed (Photos 3 through 6). The current bond for the <br />Weaver Quarry allows for a 4 acre maximum disturbance. It was also noted during the SO process that the bond amount <br />for this site has not been adjusted since 1998. Although the reclamation bond for the site is currently inadequate, a bond <br />recalculation/adjustment is required as part of the SO process. The Operator will have 60 days from the date of the surety <br />increase letter to post the appropriate financial warranty and complete the SO process. The surety increase letter and <br />supporting documentation will be sent to the operator either with this inspection report or under separate cover. <br />Evidence of noxious weeds moving into the disturbed areas of the site was also observed. DRMS strongly recommends <br />weed control measures be taken before the problem becomes more widespread and expensive to control. <br />Page 2 of 4 <br />
