<br />(d) Lessee shall comply wim all valid aM applicable
<br />laws and regulations of Fedual, Smte, and local govemmenml
<br />autlmriry.
<br />(e) Lessee shall gran[ public access to public land
<br />adjacent ro the lease by means of existing roads, trails, or ways.
<br />If the lessee must duvoy or obswm an existing route, lusee
<br />shall provide en altemasc route of equal quality. Public ]ands
<br />within the lease area and roads, trails and ways constmcted by
<br />the lessee shall be made aaessible m the public unless such
<br />acttss woWd interfere with mining operatlons or ueate a safety
<br />hazard. Limiting aaess within one-half mile of buildings and
<br />work areas ahoWd be adequate for this purpose. Any additional
<br />limitation must be approved by the BLM.
<br />(f) Good Spring Creek end the adjacent riparian habitat
<br />shall not be disturbed within the bowdaries of the lease. No
<br />mining, surface facilities or roads will be built in this area.
<br />(g) O_U1.TIIRAL RESOURCES. (1) Before
<br />undertaking any ectivitles that may distuds the surface of the
<br />teased larrds, lessee shalt cartduct n cWnrral resource intensive
<br />field inventory in a manner specified by the Aumorized Officer
<br />(AO) of the BLM or o(the surface managing agency, i(diffemnl,
<br />on portions of We mine plan area and adJecent areas, or
<br />exploration plan area that may be advesely affected by lease-
<br />relasedactivities and which wee not previously inventoried az
<br />such a level of intensity. The invenmry shall be conducmd by a
<br />qualified professional cultural resource specialist (i.e.,
<br />erchawlogist, historian, or hisrorical architect, as appropriate)
<br />approved by the AO of the surface managing agency(BLMif the
<br />surface is privately ownW), and a report of [he invenory and
<br />recornmeMations for prorating anycultural reseurcu identified
<br />shall be submitted ro the Regional D'vatm of the Office of
<br />Surface Mining, (or the D'utri<t Mining Supuvisor if activisiu
<br />are associatcd wiN <oal exploration outside an approved mining
<br />permit roes) and the AO of me BLM or me surface managing
<br />agency, if different. Lessee shall undertake measures in
<br />ettordance with insuuctions trom the Regional Direcror, (or me
<br />District Mining Supervisor if activifies are associated wim coal
<br />exploration outside an approved miniug yerndt area), m protect
<br />cultural resources on me leased land. Lessee stall nolcommerice
<br />the surface disturbing Betivities until permission to proceed is
<br />given by the Regional Direcror (or the District Mining
<br />Supervisor if activities are associated with coal exploradon

<br />(2) lessee shall protect all cultral resource propertica

<br />cultural rewurce mitigation measmu can be implemented as part
<br />of an approved mining and reclamation plan or exploration plan.
<br />(4) If cultural resomcu are discovered during
<br />operations mMer this lease, lessee shall inmedia[ely bring roam
<br />tome attention of the Regional Direcror (u the Disuict Mining
<br />Supervisor if activities are essocietcd with coal exploration
<br />ou&ide xn approved mining permit area), w the AO of me
<br />surface managing agency, if the Regional Director, or District
<br />Mining Supervisor, as appropriate, is rwtavailable. Lusa shall
<br />not disturb Such resources except as may be subuquendy
<br />authorized by the Regional Direcror (or the DisMcs Mining
<br />Supervisor if activities ere associated with coal exploradon
<br />outside an epprovod mining permit aren). Within two (2)
<br />working days of notificalian, the Regional Direcror (or the
<br />Disuict Mining supervisor if activities arc associated wim coal
<br />exploration outside en approved mining permit area) will
<br />evaluaze or have evaluated anyculmral resources disrovered and
<br />will detumine if any action ratty be required to protxt or
<br />preserve such discoveries. Cost of date rerovery for cultural
<br />resource discovered during lease opuations shall be borne by
<br />the surtece managing agency unless otherwiu spuified by the
<br />AO of she HLM or of the surface managing agency, if different.
<br />(5) Alt cutual resources shalt remain urMer the
<br />jurisdiction of the Unimd Sm[es until owrrcrship is dearmined
<br />under applicable law.
<br />(h)PALEONTOLOGICAL RESOURCES. (!)Before
<br />undertaking any activities that may disturb me surtaze of [he
<br />leased lands, lessee shall con[am the BLM to determine whether
<br />the AO will require lessee to conduct a palwnrological appraisal
<br />of the mine plan and adjacent areas, or exploration plan areas
<br />that may be adversely affected by lean-related ectivitiu. if me
<br />AO determines mat one is necessary, Ilse paleomolag¢el
<br />appraisal shall be conducted by a qualified paleontologist
<br />approved by me AO of me surface managing agency (BLM if the
<br />surface is privately owned), using the published literature and,
<br />where appropriate, field appraisals for determining dre possible
<br />existence of larger and more corpicuous fossils of sciemific
