Attn:Jim Kiger 5731 State Highway 13 Meeker, Colorado 81641 CO- 933 (KP) 3420 C -29225 C -29226 Decision JAN 2 4 2001 Stipulations Temporarily Exempted Federal coal leases C -29225 and C -29226 were issued effective June 1, 1983, and April 1, 1983, respectively. on July 24, 2000, Colowyo Coal Company L.P., requested a revision or an amendment to the Special Stipulations at Sec. 31(s), (f), (h) , and (i) because they are no longer applicable to the coal mining operations foreseen in the Green River -Hama Fork Environmental Impact Statement approved February 29, 1980. The Little Snake Field Office (LSFO) conducted resource reviews to evaluate the impacts of revising the stipulations. These actions would temporarily exempt the lessee from complying with stipulations no longer relevant to current operating and environmental conditions. The LSFO concludes that based on the Documentation of Land Use Plan Conformance and National Environmental Policy Act(NEPA) Adequacy (DNA), this proposal conforms to the applicable land use plan and the NEPA documentation fully covers the proposed action and constitutes BLM's compliance with the requirements of NEPA. Therefore, we have determined that stipulations at sec. 31(a), (f) , and (i) may be temporarily exempted until all stipulations are re- addressed at lease readjustment due in April and June, 2003. We have also determined that exemption of sec. 31(h) is not suitable at this time as it does not appear that the stipulation will affect lease operations. However, if lease operations are affected in the future, an exemption could he considered on a site specific case -by -case basis. We enclose a duplicate copy Of this decision. finder Sec. 31 of the lease, stipulations may be revised or amended, in writing, by mutual consent of lessor and lessee. To properly document our records, we request that an authorized officer of Colowyo Coal Company L.Y. indicate acceptance of the exempted stipulations at See. 31(e), (f) , and (i) by signing both decisions where indicated and returning the duplicate copy of the decision to th office.
