At the outset, we have no objection to the planned soil testing
scheduled on the Morgan property for November 22 through approximately
December 2, as referenced in the recent email from counsel for Western Fuels
Colorado, LLC ( "WFC "). Representatives of the Morgan family will plan on
attending.
However, the Morgan family has continuing objections to the legality and
content of Permit Revision Number 6. Those objections are currently stayed
while the investigations mandated by Office of Surface Mining and the Division
of Reclamation, Mining & Safety are carried out. The Morgan family has asked
me to reiterate on their behalf that their agreement with the Soil Sampling and
Analysis Plan as contemplated by TR -61 is not to be construed to be an
admission as to the suitability of any reclamation plans offered by WFC in PR -6.
In doing so we are relying in part on the statement by WFC representative Ben
Langenfeld in the review comment correspondence to DRMS, dated October 20,
2011, stating:
"the SAP laid out in TR -61 is designed to gather data for the purpose of
determining the best practices going forward in reclaiming the Morgan
Property prime farmland..TR -61 is not intended to begin this reevaluation.."
