Mr. Jared Dains, E.I. Page 5
November 16, 2011
4. The total surface area of the groundwater exposed at the Feit Pit after December 31,
1980 must not exceed 34.1 acres resulting in 94.08 acre -feet of evaporative Toss.
5. The total amount of water used at the Feit Pit site shall not exceed 1.77 acre -feet of
water lost in mined product, 13.66 acre -feet of water lost due to intermittent pit fills, and
0.8 acre -feet of water for dust control.
6. Total consumption at the pit(s) must not exceed these aforementioned amounts unless
an amendment is made to this SWSP.
7. Approval of this SWSP is for the purposes as stated herein. Any additional uses for
which the water may be used must first be approved by this office. Any future additional
historical consumptive use credit given (e.g. agricultural water transfer) for this site must .
consider all previous credits given.
8. Applicant shall replace the net evaporative depletions from the exposed ground water
surface area that may occur during the assumed ice covered period (December and
January) for any time that the exposed ground water in the pit is not completely covered
by ice.
9. The replacement water, which is the subject of this SWSP, cannot be sold or leased to
any other entity. As a condition of subsequent renewals of this SWSP, the replacement
water must be appurtenant to this site until a plan for augmentation is obtained. All
replacement water must be concurrent with depletions in quantity, timing and locations.
10. The name, address and phone number of the contact person who will be responsible for
the operation and accounting of this SWSP must be provided with the accounting form to
the division engineer and water commissioner.
11. Adequate accounting of depletions and replacements must be provided to the division
engineer in Greeley (Div1AccountinqAstate.co.us) and the water commissioner (George
Varra at George.Varra(cstate.co.us) on a monthly basis. The accounting form provided
with your application is subject to modification and approval by the division engineer. All
reported amounts shall be in acre -feet and shall reflect actual water use and not simply
projected monthly depletions from Table 3.
12. All pumping for dust control shall be measured in a manner acceptable to the division
engineer. . Permanent records of all diversions must be maintained by the well owner
(recorded at least monthly) and submitted to the division engineer and water
commissioner as required by the terms of this SWSP.
13. According to the Applicant, the distance from the surface of the exposed ground
water area to the Cache La Poudre River was measured based on the average
down - gradient extent of the exposed ground water surface. For purposes of this
SWSP, the method used to measure the distance to estimate the lagged depletions
will be accepted, however any future SWSP must measure the distance from the
exposed ground water surface area to the Cache La Poudre River based on the
centroid of the exposed ground water surface.
