( "Applicant ") to cover depletions caused by an existing gravel mining operation at the Speer <br />Mining Resources Pit (WDID 0203059) in accordance with § 37 -90- 137(11), C.R.S. The <br />required fee of $257 for the renewal of this SWSP has been received (receipt no. 3648306). <br />Plan Operation <br />The site is no longer being mined for sand and gravel, and reclamation is anticipated to <br />begin shortly. Dewatering at the site has accordingly ceased, causing the pit to fill with ground <br />water and resulting in the creation of a 26 -acre lake. It is estimated that 2.5 acres of the pit will <br />be backfilled in the first year (2011) and 5.0 acres will be backfilled in the second year (2012). <br />Until the site is completely backfilled or a liner is in place, a substitute water supply plan is <br />needed to replace depletions resulting from the exposure of ground water to the atmosphere <br />and operational losses. <br />In accordance with the letter dated April 30, 2010 from the Colorado Division of <br />Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining operators must comply <br />with the requirements of the Colorado Reclamation Act and the Mineral Rules and Regulations <br />for the protection of water resources. The April 30, 2010 letter from DRMS required that you <br />provide information to DRMS to demonstrate you can replace long term injurious stream <br />depletions that result from mining related exposure of ground water.
