This SWSP shall be valid for the period of November 1, 2011 through October 31, 2012, unless
otherwise revoked, modified, or superceded by decree. If this plan will not be made absolute by
a water court action by the plan's expiration date, a renewal request must be submitted to this
office with the statutory fee (currently $257 per site) by September 15, 2012.
2. The total area of pond surface exposed at the Riverbend West and Riverbend East after
December 31, 1980 for each of the unlined pits shall not exceed those values listed in Table A
of this approval. Should the total surface area exposed exceed those amounts, an amendment
will need to be filed with this office. The total lagged depletions resulting from operation of the
pits shall not exceed those amounts specified in attached Table 1. Should the lagged depletion
from any of the pits exceed the values listed in Table 1, an amendment will need to be filed with
this office.
3. Well permit no. 55577 -F was originally issued for DRMS File no. M- 1985 -088 for approximately
70 acres. DRMS File No. M- 2000 -006 subsequently encompassed M- 1985 -088 and now
covers approximately 1,250 acres. Prior to any groundwater exposure outside of the original 70
acres well permit no. 55577 -F covers, and new well permit will need to be applied for and a new
600 -ft spacing evaluation must be done. The applicant does not anticipate any ground water
exposure beyond the old M- 1985 -088 permit boundary and thus a new permit is not required to
be obtained for this SWSP to be valid.
4. All pumping for dust control shall be measured in a manner acceptable to the division engineer.
5. All diversions shall be measured in a manner acceptable to the division engineer. The
Applicant shall install and maintain measuring devices on all the wells nos. 1657 -RR, 2819 -F,
19944 -FR, 20317 -R and 20583 -R as required by the division engineer for operation of this
SWSP. Central has provided written permission for Applicant to use Central's meters
currently installed on these wells. For the purposes of this SWSP all use shown by
Central's meters must be fully accounted though this SWSP. Dewatering pumping must be
measured by a Totalizing Flow meter by December 31, 2011.
6. Adequate accounting of depletions and replacements must be provided to the division engineer
