Foidel Creek Mine Complete Oversight Inspection <br />Colorado Division of Reclamation, Mining, and Safety (DRMS) Permit ID # C- 1982 -056 <br />Monday, October 17 and Tuesday, October 18, 2011 <br />Operator: Twentymile Coal Company (TCC) <br />Participants: <br />Jerry Nettleton, TCC <br />Zach Trujillo, DRMS <br />Jason Musick, DRMS <br />Flynn Dickinson, OSM <br />Elizabeth Shaeffer, OSM, Badge # 377 <br />Weather conditions: 53 degrees, partly cloudy, brisk, dry ground conditions <br />This was a complete oversight inspection of the Foidel Creek Mine conducted jointly by Jason <br />Musick of the DRMS Denver Office and Elizabeth Shaeffer of OSM's Denver Field Division. <br />Jerry Nettleton (representing TCC), Zach Trujillo (DRMS), and Flynn Dickinson (OSM) joined <br />us for the inspection. <br />Records Review: <br />Mining records were evaluated during this inspection. Third quarter reports for quarterly <br />inspections and compaction testing related to excess spoil or underground development waste <br />were not yet on file, but are expected to be submitted soon. Likewise, the NPDES records on file <br />are for the 2nd quarter of 2011, and TCC will update these records when they become available. <br />TCC is contesting the increase in its reclamation cost estimate that occurred as a result of <br />DRMS' 2010 midterm review of the mine permit. Ponds A and 6NIN are MSHA ponds and are <br />inspected weekly. These inspection reports were not on file, but Mr. Nettleton was able to <br />produce them quickly since he keeps them for reference. This was also the case with the most <br />recent DRMS inspection reports. All other records are current. <br />Field Evaluation: <br />Ponds A, B, C, D, E, F, G, 6MN, the Pit Pond, the Fish Creek tipple pond, and the Fish Creek <br />borehole pond were observed during this inspection. <br />Pond A <br />Pond A is the largest pond on site that was originally constructed for the old mine. It is a stocked <br />pond that is primarily used as a water supply. This MSHA pond has a pump house with aerators <br />that are utilized in the winter months. During late spring and summer, nearly 2500 head of cattle <br />graze this area. This pond water, which is suitable for livestock, is pumped to three stock tanks, <br />which opens up the area to more grazing. • <br />
