RECEIVE <br />November 14, 2011 NOV 15 2011 <br />DIV%SIOf1 or a d Safety n, <br />Mining <br />To the Board, DRMS, and Mr. Berry <br />1 1). <br />`03 83a -8i�� <br />We a filing a formal objection to TR61 and we are also filing a request for a heaving to be held <br />here in Nucla, Colorado. We are asking for a tour of the mine with the Board members on the <br />Morgan property. This objection and request for a hearing is being done by JoElleu Turner, <br />Mike Morgan,Mary Lou Morgan and Frank Morgan. We are asking for the hearing here because <br />the Morgan property is here and all of the property is part of TR61. We are asking for a hearing <br />here because Mr. Morgan is blind and Mrs. Morgan is crippled on a walker at all times.. They do <br />not travel but this is their property and we have not been involved in any discussions prior to <br />TR61 being submitted and the only letters that we have received regarding any of this has been <br />done recently after filing that we have never received anything as was indicated in transmittals. <br />We are at the court house today and talked with Vanna and Dandle and Tr61 nor any of the <br />Adequacy reviews were at the court house. We asked them if they knew where it might be and <br />they said, no. In the paper, it States that DRMS has all of this in Denver, but that does us no <br />good here and by law, all and everything except for confidential items must be here for public <br />inspection at all times for the duration of the mining. It must be in a local location for copying <br />and inspection at all times, and it is not. We left our copies at home and came to the court house <br />to compare TR61 at the court house with PR -06 available at the court house, but TR61 was not. <br />111.60 was there and some old communications and New Horizon North, but what we needed was <br />not. <br />We are objecting and requesting a hearing for these reasons: <br />A Technical Revision is a minor change made to an existing revision or permit. TR61 is totally <br />inclusive of PR-06. TR61 was suppose to be a minor change that added testing and sampling to <br />an existing permit. TR61 incorporates an entire section of PR-06 into it and by doing so, it <br />reinstates PR -06 which we have a current appeal in District Court to and which we will never <br />accept. PR -06 was founded on false information, misrepresentation, false documentation to the <br />State and to the Board that made a wrong and inaccurate conclusion. We are not accepting PR- <br />06 and by WFC making PR -06 as the major portion of TR61, we will not accept TR61 until all of <br />PR -06 is taken out of TR61. <br />A technical revision does not incorporate the permit or the permit revision. A technical revision <br />is incorporated by a permit or a permit revision. This is something in the permit or permit <br />revision that is getting changed, added to, or altered that does not affect the reclamation or the <br />revegetation of an existing permit or permit revision. This was not OSM's intentions nor the <br />States when WFC was instructed to do a technical revision as we understand it. <br />
