ephemeral drainage. The proposed operation will not affect any of the area tributary
to this drainage; therefore, there should be no effect on the water supply to this
subirrigated area.
3) The valley floor exists within the affected or adjacent area. The alluvial valley floors of
the Colorado River and Alkali Creek are located adjacent to but not on the disturbed area.
The Division finds that activities proposed by the applicant will:
not interrupt, discontinue, or preclude farming on the alluvial valley floors that are
irrigated or naturally subirrigated [2.06.8(5)(a)(i) and 4.24.3(1)].
not materially damage the quantity or quality of water in the surface or ground water
system described above [4.24.3(3) and 2.06.8(5)(a)(ii)].
will comply with the requirements of the Act and the Regulations with respect to alluvial
valley floors [2.06.8(5)(a)(iii)].
Environmental monitoring of surface water is to continue until all bonds are released in
accordance with Rule.4.24.4.
XVIII. Operations on Prime Farmland
The Division has made a determination that there are no prime farmlands within the
proposed permit area. The decision was based on evidence provided by the Soil
Conservation Service which appears on pages 3 -171 to 3 -173 in Volume I of the PAP. The
Division makes no approvals with regard to such operations [4.25.2(3), 4.25.4(2), and
4.25.5(2)].
XIX. Mountaintop Removal
There is no mountaintop removal at the site. Therefore, the Division makes no approvals
with regard to such operations [4.26.2(2)].
XX. Operations on Steep Slopes
There are no operations on steep slopes at the site. Therefore, the Division makes no
approvals with regard to such operations [2.06.4, 2.06.5, 4.27, 4.27.3, 4.27.3(6), 4.27.4,
4.27.3(7), 4.27.3(8), 4.27.4(3), and 4.27.5)].
XXI. In Situ Processing
There are no in situ processing operations on site. Therefore, the Division makes no
approvals with regard to such operations [4.29.2(2)(a), 4.29.2(2)(b), and 4.29.3)].
This concludes the proposed Proposed Decision and Findings of Compliance for Permit Renewal
6 for the Coal Ridge No. 1 Mine.
Coal Ridge No. 1 Mine
Permit Renewal 6 21 31 October 2011
