[Rule 4.03.1(1)(e)]. The Division approved the retention of roads since they were compatible <br />with, and support [Rule 4.04.4(7)], the approved post- mining land use (agricultural), and a <br />request for their retention was submitted by the landowner [Rules 4.03.1(1)(f)(ii) and <br />4.03.2(1)(g)(ii)]. No portion of the road is located in the channel of any stream [Rules <br />4.03.1(2)(b) and 4.03.3(2)(b)]. There is no ford of an ephemeral or intermittent stream [Rules <br />4.03.1(2)(c) and 4.03.3(2)(c)].There are no alternative specifications for cut slopes are approved <br />by the Division [Rule 4.03.1(3)(d)(i)]. There are no alternative specifications for embankment <br />slopes approved by the Division [Rule 4.03.1(3)(e)(ix)]. There is no alteration or relocation of a <br />natural channel drainageway [Rule 4.03.1(4)(a)(i)]. There are no alternative specifications for <br />culvert and bridge sizing approved by the Division [Rule 4.03.1(4)(e)(vi)]. There is no <br />specification of a lesser road grade approved by the Division [Rule 4.03.3(3)(a)]. The Division <br />approved the retention of the one remaining road reclassified as a light -use road [Rule 4.03.3(7)]. <br />II. Support Facilities - Rule 4.04 <br />The only support facilities constructed during the initial phase of the mine operation, other than <br />sedimentation control structures, were a powder magazine, a water tower, a pump house, a water <br />line, and roads. All were constructed in accordance with Rule 4.04. All, except for the <br />sedimentation control structures and permanent roads, were removed at the time of initial <br />reclamation. The permit is in cessation and reclamation. No new support facilities are proposed <br />during the ensuing term of the permit. No past or existing support facilities incurred damage, <br />destruction, disruption of oil, gas, or water wells or pipelines, coal slurry pipelines, railroads, or <br />utility lines (none passed over, under, or through the permit area). Therefore, no written approval <br />from the owner of such facilities were received by the Division, and no approvals by the <br />Division were granted [4.04(6)]. <br />III. Hydrologic Balance - Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations <br />Runoff from the majority of the disturbed areas passes through a sediment pond prior to leaving <br />the permit area. The Division granted small area exemptions from the use of sediment ponds. <br />The exemptions are based on the limited size of the areas and the operator's demonstration (PAP <br />Exhibit 4.7 -3) that ponds and treatment facilities are not necessary for the drainage to meet the <br />effluent limitations of Rule 4.05.2 and applicable State and Federal water quality standards for <br />receiving streams. There is no mixing of surface drainage with a discharge from underground <br />workings [Rule 4.05.2(3)(b)(i)]. Small Area Exemption No. 1, about 1/2 an acre, is located <br />directly east of the sediment pond. Small Area Exemption No. 2, about 4 acres, is located to the <br />west of the sediment pond, and adjacent to County Road 335. Runoff through these areas is <br />filtered prior to discharge off -site. See Map 4.7 -1 of the permit for locations of the small area <br />exemptions. [Rule 4.05.2(3)(a)]. A study has been incorporated into the PAP that indicates <br />reclamation activities have progressed to the extent that sedimentation control measures are no <br />longer required at the site. A full Phase II Bond Release (SL -02) was approved on 17 August <br />2001. <br />B. Hydrologic Monitoring Program <br />Prior to reclamation of the site, groundwater was monitored in seven colluvial wells.
