Public Access and Safety: <br />o The operator will be required to gate the access to the 9400' portal with Forest <br />Service approved fencing material to promote public safety. <br />o Gates will be required at the entrances to temporary access roads. <br />Heritage: <br />o If a previously unknown site is discovered by either the operator or the Forest <br />Service, excavation operations that could impact the new site would stop immediately <br />until the site is evaluated by the Forest Service and any needed mitigation measures <br />are developed. <br />o If new proposed excavation sites are proposed that are outside the project area, <br />additional Heritage Resource surveys, documentation and SHPO concurrence would <br />be required. <br />Vegetation and Noxious Weeds: <br />o Reclamation seed mixes must include only native species, and must exclude all <br />potentially invasive species. When purchasing seed, the operator must obtain a <br />written statement indicating that the seed being purchased is weed -free. Seed mix use <br />will be consistent with the Reclamation Prescriptions for the Foothills and <br />Mountain Ecosystems of the San Luis Valley Area (1998). <br />o The operator will seed all recontoured excavation sites, associated topsoil piles and <br />reclaimed roads at the end of the project. Seeding will be done in the spring or fall, <br />optimally before the first snowfall. <br />A financial warranty (reclamation bond) must be provided and approved by the Colorado <br />Division of Reclamation, Mining and Safety (CODRMS) and the Forest Service prior to <br />entering the project area for exploration construction.
