<br />Dear Neighbor,
<br />We are presently excavating to construct a house pad, parking, and storage on our
<br />property at 355 River Run Drive west of Pagosa Springs. Because we are removing the
<br />dirt we excavate from the site, we must obtain a reclamation permit from the State. As
<br />part of that process of getting a permit we must publish a notice in the newspaper (the
<br />Pagosa Springs Sun) and then mail everyone who owns land within 200 feet of our
<br />property a copy of this notice:
<br />Dale and Ellen Schmidt, 372 Meadows Drive, Pagosa Springs, CO 81147, (970) 946 -6262, have
<br />filed an application for a Construction Materials Limited Impact (110) Reclamation Permit with
<br />the Colorado Mined Reclamation Board under provisions of the Colorado Land Reclamation
<br />Act for the Extraction of Construction Materials, The proposed operation is known as the Schmidt
<br />Site, and is located at or near Sections 12 and 1, Township 34 North, Range 03 West, 10th P.M,
<br />The proposed date of commencement is December 1st, 2011, and the proposed date of
<br />completion is November 30' 2015. The proposed future use of the land is residential and related
<br />uses.
<br />Additional information and tentative decision date may be obtained from the Division of
<br />Reclamation, Mining, and Safety, 1313 Sherman Street, Room 215, Denver, Colorado 80203,
<br />(303) 866 -3567, or at the Archuleta County Clerk and Recorder's office, Courthouse, 449 San
<br />Juan Blvd, Pagosa Springs, Colorado, or the above -named applicant.
<br />Comments concerning the application and exhibits must be in writing and must be received by
<br />the Division of Reclamation, Mining, and Safety by 4:00 p.m. on October 16th, 2011.
<br />Please note that under provisions of C.R.S. 34- 32.5 -707 et seq. comments related to noise, truck
<br />traffic, hours of operation, visual impacts, effects on property values and other social or
<br />economic concerns are issues not subject to this Office's jurisdiction. These subjects, and similar
<br />ones, are typically addressed by your focal governments rather than the Division of
<br />Reclamation, Mining, and Safety or the Mined Land Reclamation Board.

<br />permitting, including land use, conditional use, and building permits, which we will be
<br />applying for soon.
