Preliminary Adequacy Review No. 213
Dear Mr. Shrestha:
Preliminary Adequacy Review (PAR) Nos. 2 and 2A were issued by the Division on September
9 and 16, 2011, respectively. At the request of Western Fuels, a meeting to discuss PAR 2 and
2A was convened in Denver on September 27, 2011. This meeting was attended by Kent Crofts,
Murari Shrestha, and Ryan Lunde for Western Fuels. Sandy Brown, Brock Bowles, Mike
Boulay (by phone) and Marcia Talvitie represented the Division. In addition to items already
included in PAR letters, the Division verbally addressed newly- discovered issues regarding
topsoil salvage and replacement.
The purpose of this letter is to formally itemize additional observations the Division has made
regarding land use, soil resource and soil replacement. Items are numbered here so as to dovetail
with items identified in the previous PAR letters.
2.04.3 — Site Description and Land Use Information
13. Grazingland
a) The " Grazingland" land use is discussed beginning on page 4 of Section 2.04.3 of the
PAP. The acreage given in the first paragraph is 163.69 acres, which conflicts with the
93.60 acres shown on Map 2.04.3 -1 — Land Use. Assuming the map acreages are
correct, please revise this paragraph to give the correct acreage (and percentage of the
permit area) and to indicate that Grazingland is the second largest land use category.
b) In the second paragraph of the Grazingland section, a designation of Grazingland-
Reclamation (GL -REC) is described for certain areas of the original NH1 mine. This
conflicts with the map notation, which shows Pastureland Topsoiled Reclamation (PL-
REC) for the NHl areas. Please compare this text with Map 2.04.3 -1. If the Map is
correct, please move this paragraph to the "Pastureland" section which follows, and
