Box 33424 <br />Denver, Colorado 80233 -3424 <br />Re: New Horizon North Mine — Permit Application No. C -2010 -089 <br />Preliminary Adequacy Review No. 213 <br />Dear Mr. Shrestha: <br />Preliminary Adequacy Review (PAR) Nos. 2 and 2A were issued by the Division on September <br />9 and 16, 2011, respectively. At the request of Western Fuels, a meeting to discuss PAR 2 and <br />2A was convened in Denver on September 27, 2011. This meeting was attended by Kent Crofts, <br />Murari Shrestha, and Ryan Lunde for Western Fuels. Sandy Brown, Brock Bowles, Mike <br />Boulay (by phone) and Marcia Talvitie represented the Division. In addition to items already <br />included in PAR letters, the Division verbally addressed newly- discovered issues regarding <br />topsoil salvage and replacement. <br />The purpose of this letter is to formally itemize additional observations the Division has made <br />regarding land use, soil resource and soil replacement. Items are numbered here so as to dovetail <br />with items identified in the previous PAR letters. <br />2.04.3 — Site Description and Land Use Information <br />13. Grazingland <br />a) The " Grazingland" land use is discussed beginning on page 4 of Section 2.04.3 of the <br />PAP. The acreage given in the first paragraph is 163.69 acres, which conflicts with the <br />93.60 acres shown on Map 2.04.3 -1 — Land Use. Assuming the map acreages are <br />correct, please revise this paragraph to give the correct acreage (and percentage of the <br />permit area) and to indicate that Grazingland is the second largest land use category. <br />b) In the second paragraph of the Grazingland section, a designation of Grazingland- <br />Reclamation (GL -REC) is described for certain areas of the original NH1 mine. This <br />conflicts with the map notation, which shows Pastureland Topsoiled Reclamation (PL- <br />REC) for the NHl areas. Please compare this text with Map 2.04.3 -1. If the Map is <br />correct, please move this paragraph to the "Pastureland" section which follows, and <br />Office of Office of <br />Mined Land Reclamation Denver ® Grand Junction - Durango Active and Inactive Mines <br />
