Exhibit No. 82, TR 127 <br />Refuse Pile Expansion East <br />Mountain Coal Company, LLC <br />• West Elk Mine <br />Addendum No. 1 <br />October 3, 2011 <br />of the underdrain to a minimum of 2 feet beyond the lateral limits of the underdrain. A minimum <br />of 2 feet of filter rock will extend past the top geotextile on either side of the underdrain. The <br />intent of the extended filter rock zone is to allow drainage to enter the underdrain in the event that <br />geotextile becomes plugged. A detail of the underdrain configuration is shown on Drawing C- <br />07A. <br />The horizontal alignment of the underdrain beneath the refuse pile will follow the thalweg of the <br />gulch and may be adjusted based on the type of material encountered in the area of the underdrain <br />and the ability to excavate the drain without hardship. <br />Drawing C -07 shows a lateral drain extension that will be constructed to drain any seeps that may <br />be uncovered in the foundation of the refuse pile as it is developed. Lateral drains will be <br />constructed from seep locations approximately perpendicular to the refuse pile foundation surface <br />contours to the thalweg underdrain. The specific dimensions of lateral drains will be determined <br />based on estimated seepage rates. <br />• 3. Delete Section 4.8.2 in its entirety and replace with the following text: <br />• <br />4.8.2 Routine Quarterly Refuse Pile Inspections <br />The refuse pile will be inspected quarterly by a by a qualified registered engineer, or other <br />qualified professional specialist under the direction of the professional engineer, experienced in <br />construction of similar earth and waste structures, approved by the Division. Inspections will be <br />conducted quarterly, beginning within seven days after completion of refuse pile area preparation <br />construction. Inspections will continue until the refuse pile has been graded, covered in <br />accordance with 4.10.4(4), vegetative soil has been distributed, and the area revegetated in <br />accordance with the reclamation plan (Section 8). <br />Inspections will include observation of seepage rates, review of slopes for indications of <br />movement, and such observations and tests as may be necessary to evaluate the potential hazard <br />to human life and property. Inspections will include review of preparation of new refuse pile <br />development areas to ensure that all organic material, and topsoil have been removed and that <br />proper construction and maintenance are occurring in accordance with the intent of the design <br />P:\Mpls \06 CO\26 \06261003 RPE E.
