(8) Each application shall contain the name of the proposed mine and the Mine Safety and Health <br />Administration identification number for the mine and all sections, if any. <br />• RESPONSE <br />The name of the mine is the Foidel Creek Mine. The Mine Safety and Health Administration has <br />assigned the Foidel Creek Mine the identification number of 05- 03836. <br />(9) Each application shall contain a statement of all lands, interests in lands, options, or pending bids on <br />interests held or made by the applicant for lands which are contiguous to the area to be covered by the permit. <br />Information required by this paragraph may be considered confidential for purposes of these rules if the <br />requirements of 2.07.5 are met. <br />RESPONSE <br />TCC does not hold any interests in lands, options, or pending bids on interests for lands which are <br />contiguous to the area to be covered by the permit. <br />(10) The applicant shall submit the information required by 2.03.4 and by 2.03.5. <br />RESPONSE <br />Please refer to the responses to Rules 2.03.4 and 2.03.5 as it is understood the CDRMS does not <br />have a form at this time. <br />Rule 2.03.5 - Compliance Information. Each application shall contain: <br />* (I) A statement of whether the applicant, any subsidiary, affiliate, or persons controlled by or under common <br />control with the applicant has: <br />(a) Had a Federal or State mining permit for surface coal mining operations suspended or <br />revoked in the last five years prior to the date of submission of the application; or <br />RESPONSE <br />The applicant, any subsidiary, affiliate, or persons controlled by or under common control with the <br />applicant has never had a Federal or State mining permit suspended or revoked. <br />(b) Forfeited a mining bond or similar security deposited in lieu of bond. <br />RESPONSE: <br />The applicant, any subsidiary, affiliate, or persons controlled by or under common control with the <br />applicant has never forfeited a mining bond or similar security deposited in lieu of bond. <br />(c) The current status of the permit, bond, or similar security involved; <br />(d) The date, location, and type of any administrative or judicial proceedings initiated <br />concerning the e suspension, revocation or forfeiture; and <br />(e) The current status of these proceedings. <br />• <br />MR10 -241 2.03 -19 03/05/10 <br />
