Climax could apply to the Board for an extended reclamation period for the <br />Leadville Mine as contemplated in section 112(7) and 116(7)(q) of the MLRA. Section <br />1 12(7) provides that: `Each phase of reclamation is to be completed within five years <br />after the date the operator advises the board that such phase has commenced, as provided <br />in the introductory portion of section 34- 32- 116(7)(q); except that such period may be <br />extended by the board upon a finding that additional time is necessary for the completion <br />of the terms of the reclamation plan." (Emphasis supplied) Section 1 16(7)(q) provides <br />in relevant part that all reclamation is to be "carried to completion by the operator with all <br />reasonable diligence and shall be conducted concWTently with mining operations to the <br />extent practicable, taking into consideration the mine plan, mine safety, economics, the <br />availability of equipment and material, and other site specific conditions relevant and <br />unique to the affected land and to the postmining land use." This section, like section <br />112(7), also allows the Board to "extend" the reclamation period of reclamation <br />consistent with the provisions of section 112(7). <br />The Leadville Mine is a "high altitude" mine, which has unique challenges <br />regarding revegetation success. Because of the difficulties of successfully revegetating <br />at high altitudes, the Board could reasonably determine that the reclamation period for the <br />Leadville Mine should be extended past the general 5 year period. In addition, because <br />of the unique characteristics of the molybdenum market and the fact that Climax owns <br />the only two moly mines in the state, and Climax has indicated the need to finish <br />developing the reserves in the Henderson Mine as an economic matter prior to <br />redeveloping the ore reserves in the Leadville Mine, economics of both Climax and the <br />world market would also be a statutorily authorized reason the Board could extend the <br />reclamation period for the Leadville Mine. This would probably require that Climax <br />report to the Board, e - : • • is, the state of its production , ore reserves at <br />Henderson, and the world market along with the status of its revegetation efforts at the <br />Leadville Mine. <br />
