Pineda Director RE: Red Rock Pit, Permit No. M- 1978 -315, Receipt of Incomplete Construction Material Regular (112) Operation Reclamation Permit Conversion Application Package (CN1) On October 18, 2011 the Division of Reclamation, Mining and Safety (Division) approved the Transfer of Permit and Succession of Operators application (SOl), replacing Routt County as the permit holder, with Peabody Sage Creek Mining, LLC for the above stated site. As you know, the Construction Materials Regular (112) Operation Reclamation Permit Conversion Application (CN1), that was submitted on May 9, 2011, was not considered submitted at that time because Peabody Sage Creek Mining, LLC was not yet the permitted Operator for the site. The Division has retained your CN1 application, which was considered submitted on October 18, 2011, the date that Peabody Sage Creek Mining, LLC assumed Permit No. M- 1978 -315. A preliminary review of the information submitted with CN1 determined that the following items must be received before the Division can consider the application complete and technical review can begin: Office of Office of Denver • Grand Junction • Durango Active and Inactive Mines
