Rationale for Conditional Approval of CN -01 <br />May Day Idaho Mine Complex, M- 1981 -185 <br />8. Concerns regarding the reclamation of exploration road. (Aweida and Hughes) <br />The application originally included 11 exploration drill pads and associated access roads. With <br />the application materials submitted on August 9, 2011, the Applicant removed all references to <br />the 11 exploration drill pads and associated access roads. Therefore, the drill pads and <br />associated access roads are no longer part of the application and will not be included as <br />permitted activities. <br />9. Concerns regarding adverse impacts to the quality and quantity of ground water. <br />Concerns regarding adverse impacts to the domestic water wells located nearby the <br />operation. Concerns regarding the underground disposal of mill tailings. Concerns <br />regarding the determination of baseline conditions for ground water. (Aweida, <br />Giovanniello, Greaves, Hughes, Linden, Perkins and Vigil) <br />The Applicant has not yet commenced sampling and monitoring of ground water necessary to <br />determine baseline conditions. The application proposes a plan for ground water monitoring <br />sufficient to determine baseline conditions and verify continued compliance with water quality <br />laws and regulations, but the wells have not yet been drilled. See Recommended Conditions <br />for Approval, item 4. <br />This issue of underground disposal of mill tailings, and other mined materials, is a ground water <br />issue. Per the Division's recommendation for conditional approval, no mining or milling <br />activities may occur until the Applicant fully satisfies all corrective actions and fully <br />demonstrates that the proposed mining and milling activities will comply with the requirements <br />of the Act and Rules. See Recommended Conditions for Approval, items 4 and 6. <br />10. Concerns regarding the storage of contaminated mill water. (Aweida and Hughes) <br />See Recommended Conditions for Approval, item 6. <br />11. Concerns regarding an incorrect reference to the amount of precipitation identified in <br />Exhibit K, Climate. (Aweida and Hughes) <br />The Applicant corrected the error during the review process, through the exchange of adequacy <br />issues and response to adequacy issues. <br />12. Concerns regarding the illegal access road, subject of Violations MV -2009 -007 and MV- <br />2009 -033. (Aweida, Barfoot, Fagerlin, Filler, Giovanniello, Holland, Hughes, Karls, La <br />Plata County Planning Department, Linden, Steele and Willis) <br />See Recommended Conditions for Approval, item 1. <br />13.
