Staff notes that the <br />original 18 holes and pads have been reclaimed. There are some minor issues in regard to cutting <br />disposal observed, however for the most part all are fully reclaimed. Pineda <br />Director <br />RE: Notice of Intent to Conduct Prospecting (NO1), P- 2008 -059, Tenderfoot Mesa, Modification MD -2, <br />review. <br />On September 29, 2011 the Division of Reclamation, Mining, and Safety (Division) received Energy Fuel's <br />request for a modification to the above referenced NOI. The Division posted the non - confidential on the <br />Office website on October 3, 2011 and no comments were received within 10 days, October 14, 2011. <br />1. No reclamation liability figure was submitted. Staff will calculate the reclamation liability once <br />the other issue is clarified. <br />2. As noted by Energy Fuels, proof of notice to the Mesa County Commissioners has not yet been <br />received. <br />3. The application notes no new roads or disturbances. However on a site inspection on October <br />12, 2011, the Division noted that access to holes A, B, and 0 appeared to require some major <br />brush clearing and some possible earth work. Please clarify what work will be done and an <br />approximate linear footage to access these sites. <br />Per Rule 5.1.3(c), the Division is notifying the applicant of the above reference deficiencies. The <br />applicant shall address the deficiencies within sixty (60) days of this letter (December 27, 2011, based on <br />weekend and holiday) or the Office may terminate the NOI file. <br />Office of Office of <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />
