IN REPLY REFER TO: <br />ES/CO: ES/Species/Plants/ <br />SD /Survey Reports <br />Mail Stop 65412 LK <br />United States Department . of the Interior <br />FISH AND WILDLIFE SERVICE <br />Ecological Services <br />755 Parfet Street Suite 361 <br />Lakewood, Colorado 80215 <br />SEP 1 2 2002 <br />Edith Savage <br />Savage and Savage <br />464 West Sumac Court <br />Louisville, Colorado <br />Dear Ms. Savage: <br />Based on the authority conferred to the U.S. Fish and Wildlife Service (Service) by the Endangered <br />Species Act of 1973 as amended (16 U.S.C. 1531 et sm.) the Service reviewed the Ute ladies' tresses <br />orchid (Spiranthes chluvialis) survey report for Hainrwnn s proposed Bernhardt Resource Project in <br />Weld County Colorado (Township 4 North, Range 67 West, South 1)_ i <br />The proposed project site is <br />bounded on the north by the Big Thompson Ri 'A ver on the east by Weld County Road 25, on the south by <br />Weld County Road 48, and on the west by Weld County Road 23. <br />The Service finds the habitat assessment report acceptable and agrees that although suitable habitat for S. <br />dhtvialis is present in some areas, no individuals or populations of the orchid were located. Therefore, <br />the Service concurs with the determination that the proposed project is not likely to adversely affect the <br />continued existence of the orchid. <br />We appreciate your submitting t J��cKee at our office 275 -2ev0w and comment.
