Dear Mr. Winter, On October 19, 2011, the Office approved the NOI application for the Bear Hug site; DRMS File No. P- 2011 -028. The Division also received the required financial warranty of $2,268.23. In accordance with Rule 5.1.3 (d) (II) -(IV), any person who filed a timely comment and who meets the definition of a party may appeal an Office determination within five (5) business days from the date the Office sends notice of its decision. If an appeal is received, the Board shall hear any such appeal at its next regularly scheduled meeting that is at least ten (10) calendar days from the date of such appeal. The Office's determination shall not take effect until the expiration of the five (5) business days allowed for an appeal, or, in the case of an appeal, until the Board issues its decision. If an appeal is not received within the time frame discussed above, the Division will send you a notice indicating you can commence prospecting.
